Abstract
This chapter questions the starting assumptions in thinking through questions of “jurisdiction” in public law, specifically in relation to assertions of inherent Indigenous territorial governing authority. It reviews the common conceptual images of jurisdiction we employ in law schools and offers resources from critical interdisciplinary theory for new conceptions. In highlighting examples of the present exercise of Indigenous territorial jurisdiction, such as the Kunst'aa guu— Kunst'aayah Reconciliation Protocol and the Tsleil-Waututh Sacred Trust Assessment of the Trans Mountain Expansion (TMX) project, the chapter urges public law scholars to adopt an orientation of prefiguration in order to bring into being conceptualizations of jurisdiction that can enliven a decolonial legal future and a new constitutional order.
French Abstract
Ce chapitre remet en question les hypothèses de départ concernant les questions de « compétence » en droit public, en particulier en ce qui concerne les affirmations relatives à l’autorité gouvernementale territoriale autochtone inhérente. Il examine les représentations conceptuelles courantes en ce qui a trait à la compétence véhiculée dans les facultés de droit et propose des notions issues de la théorie critique interdisciplinaire pour envisager de nouvelles conceptions. En mettant en lumière des exemples actuels de l’exercice de la compétence territoriale autochtone, tels que le Protocole de réconciliation Kunst'aa guu—Kunst'aayah et l’Évaluation sacrée du projet d’expansion Trans Mountain (TMX) par les Tsleil-Waututh, le chapitre invite les spécialistes en droit public à adopter une orientation de préfiguration. Cela vise à concevoir des conceptualisations de compétence pouvant donner lieu à un avenir juridique décolonial et un nouvel ordre constitutionnel.
