Abstract

As the Supreme Court of Canada reminded us on several occasions, if copyright holders have rights, so do users. In her new book, Dr. Pascale Chapdelaine offers a comprehensive multi-jurisdictional perspective on copyright user rights anchored in property, contracts, and copyright law and theory. Pointing to double standards in how traditional concepts of law apply to copyright holders and users, she paves the way toward substantiating the rights of users in an increasingly dematerialized world.

Pascale Chapdelaine is Associate Professor at the University of Windsor, Faculty of Law. Her research looks at the interaction between intellectual property, property and contracts, as well as to how new technologies and automated business processes shape consumers’ rights and expectations. Prior to joining the Faculty of Law in 2014, Prof. Chapdelaine practised law for over fourteen years as Vice-President, and legal counsel at Bell Canada and BCE Inc. in intellectual property and commercial law, and as associate at the Montreal-based law firm Lavery de Billy in corporate, commercial and securities law.

Prof. Chapdelaine holds an LLB and BCL from McGill University, Faculty of Law, an LLM from the K.U. Leuven Faculty of Law (Belgium) and a PhD from Osgoode Hall Law School. She is called to the Bar of Ontario and le Barreau du Québec.

Bob Tarantino will lead the book launch discussion. Mr. Tarantino is Counsel at Dentons Canada LLP. His practice is focussed on the interface between the entertainment industries and intellectual property law, with an emphasis on film and television production, financing, licensing, distribution, and IP acquisition and protection. His clients range from artists and independent producers to Canadian distributors and foreign studios and financiers at every stage of production, from development to delivery and exploitation.
